Coast, the crime is punishable, but if the SENTENCE can vary based on the circumstances of the crime, then I believe the sentence should be greater.
Also, to answer your question concerning if the deceased wife was the one having the affair instead, then if the disclosure of the adultery is what led to Nigel killing her (without planning premeditation), i.e. a crime of passion, then the sentence should be less IMO, because it should take into consideration Nigel's emotional state at the time. I think our society pays very little attention to the significant emotional and psychological harm caused by adultery, and that's reflected in your post. But that's a topic for a whole other discussion...
